These general terms and conditions of sale (hereinafter the “GTCs”) apply to any purchase made by any natural person acting as a consumer and not as a trader (hereinafter the “CLIENT”) on the website https://yuumae.com (hereinafter the “SITE”), published by YUUMAE, a société par actions simplifiée (simplified joint-stock company) with share capital of €1,000, whose registered office is located at 49 RUE DE PONTHIEU, 75008 PARIS, registered with the Paris Trade and Companies Register under number 992 547 828, represented by its President, and hosted by OVH.
In this context, the CLIENT and YUUMAE agree that the GTCs govern, together with the order as accepted by YUUMAE, the conditions of use of the SITE and exclusively govern their relationship.
The purchase of a Product on the SITE implies full and unconditional acceptance by the CLIENT of the GTCs, which apply to any purchase delivered within the TERRITORY.

1. Definitions
The terms used below have the following meanings in the GTCs:
CLIENT: means any natural person acting as a consumer and not as a trader who purchases one or more PRODUCTS via the SITE;
DELIVERY: means the first presentation of the PRODUCTS ordered by the CLIENT at the delivery address indicated at the time of the order;
PRODUCT(S): means one or more products that may be ordered on the SITE. PRODUCTS are offered subject to availability. YUUMAE makes every effort to ensure that the photographic representation of the PRODUCTS is as accurate as possible. However, it is possible that your perception of the photographic representation of the PRODUCTS on your own screen may not exactly correspond to the PRODUCT.
SITE: means the website https://www.yuumae.com/;
TERRITORY: means mainland France, the French overseas departments and territories (DOM-TOM) and Belgium;
YUUMAE: means the company YUUMAE, a société par actions simplifiée with share capital of €1,000, whose registered office is located at 49 RUE DE PONTHIEU, 75008 PARIS, registered with the Paris Trade and Companies Register under number 992 547 828, represented by its President.
2. Purpose
The GTCs are intended to define the contractual relationship between YUUMAE and the CLIENT and the conditions applicable to any purchase made via the SITE.
The buyer is clearly informed and acknowledges that the SITE is intended for consumers, and that professionals must contact YUUMAE’s sales department in order to benefit from distinct contractual conditions at the following email address: contact@yuumae.com.
The purchase of a product through the SITE implies full and unconditional acceptance by the CLIENT of the GTCs, which the CLIENT acknowledges having read prior to placing an order. Before any transaction, the CLIENT declares, on the one hand, that the purchase of PRODUCTS on the SITE is not directly related to his or her professional activity and is limited to strictly personal use, and, on the other hand, that he or she has full legal capacity enabling him or her to be bound by the GTCs.
YUUMAE reserves the right to amend these GTCs at any time, in order to comply with any new regulations or with a view to improving the use of the SITE. Consequently, the applicable GTCs are those in force on the date the order is placed by the buyer.
3. Acceptance of the GTCs
The CLIENT undertakes to read the GTCs carefully and to accept them by ticking the box reserved for this purpose, thereby indicating the CLIENT’s consent to the GTCs, before proceeding with payment for any order of PRODUCTS placed on the SITE.
The GTCs are accessible via a link at the bottom of each page of the SITE and must be consulted before placing any order. The CLIENT is invited to read carefully, download, print and retain a copy of the General Terms and Conditions.
YUUMAE advises the CLIENT to read the General Terms and Conditions with each new order, as the latest version of said conditions applies to any new order of PRODUCTS.
4. Purchase of PRODUCTS on the SITE
To be able to purchase a PRODUCT, the CLIENT must be at least 18 years old and have legal capacity or, if a minor, be able to prove the consent of his/her legal representatives.
The CLIENT will be invited to provide information allowing him/her to be identified by completing the form available on the SITE. An asterisk (*) indicates the mandatory fields that must be completed for the CLIENT’s order to be processed by YUUMAE and its logistics subcontractor.
The CLIENT may check the status of his/her order on the SITE.
Order tracking may, where applicable, be carried out using the online tracking tools of certain carriers. The CLIENT may also contact YUUMAE’s sales department at any time by email at contact@yuumae.com in order to obtain information on the status of his/her order.
The information that the CLIENT provides to YUUMAE when placing an order must be complete, accurate and up to date. YUUMAE reserves the right to ask the CLIENT to confirm, by any appropriate means, his/her identity, eligibility and the information provided.
5. Orders
5.1 Product characteristics
YUUMAE undertakes to present the essential characteristics of the PRODUCTS (on the information sheets available on the SITE) and the mandatory information that the CLIENT must receive under applicable law.
The CLIENT undertakes to read this information carefully before placing an order on the SITE.
Unless expressly stated otherwise on the SITE, all PRODUCTS sold by YUUMAE are new and comply with the European legislation in force and with the standards applicable in France.
5.2. Ordering procedure
Orders for PRODUCTS are placed directly on the SITE. To place an order, the CLIENT must follow the steps described below (it being understood that, depending on the CLIENT’s start page, these steps may vary slightly).
5.2.1. Selection of PRODUCTS and purchase options
The CLIENT must select the PRODUCT(S) of his/her choice by clicking on the relevant PRODUCT(S) and selecting the desired quantities. Once the PRODUCT is selected, it is placed in the CLIENT’s basket. The CLIENT may then add as many PRODUCTS as he/she wishes to the basket.
5.2.2. Orders
Once the PRODUCTS have been selected and placed in the basket, the CLIENT must click on the basket and check that the contents of the order are correct. If the CLIENT has not yet done so, he/she will then be invited to log in or register.
Once the CLIENT has validated the contents of the basket and logged in / registered, an online form summarising the price, applicable taxes and, where applicable, delivery charges will automatically be displayed.
The CLIENT is invited to verify the contents of his/her order (including the quantity, characteristics and references of the PRODUCTS ordered, the billing address, payment method and price) before validating it.
The CLIENT may then proceed to pay for the PRODUCTS by following the instructions provided on the SITE and by providing all necessary information for the billing and DELIVERY of the PRODUCTS. For PRODUCTS for which options are available, these specific references appear when the appropriate options have been selected. Orders placed must contain all the information necessary for proper processing of the order.
The CLIENT must also select the desired delivery method and indicate his/her agreement to the GTCs.
5.2.3. Acknowledgement of receipt
Once all of the above steps have been completed, a page appears on the SITE acknowledging receipt of the CLIENT’s order. A copy of the order acknowledgement is automatically sent to the CLIENT by email, provided that the email address communicated via the registration form is correct.
YUUMAE does not send any order confirmation by post or fax.
YUUMAE reserves the right to refuse any order. In such case, YUUMAE will inform you as soon as possible, stating the reasons for such refusal, and will reimburse all sums paid by you within a maximum period of 14 days following your order.
5.2.4. Invoicing
During the ordering procedure, the CLIENT must enter the information necessary for invoicing (fields marked with an asterisk (*) are mandatory for the CLIENT’s order to be processed by YUUMAE).
The CLIENT must clearly indicate all information relating to DELIVERY, in particular the exact delivery address, as well as any access code to the delivery address.
The CLIENT must then specify the chosen payment method.
Neither the online order form completed by the CLIENT nor the order acknowledgement sent by YUUMAE by email constitutes an invoice, regardless of the method of order or payment used.
5.3. Date of the order
The date of the order is the date on which YUUMAE acknowledges receipt of the order online. The time limits indicated on the SITE only begin to run from this date.
5.4. Price
For all PRODUCTS, the CLIENT will find on the SITE prices displayed in euros including all taxes, as well as applicable delivery charges (depending on the weight of the parcel, excluding packaging and gifts, the DELIVERY address and the carrier or mode of transport chosen).
Prices include, in particular, value added tax (VAT) at the rate in force on the order date. Any change in the applicable rate may affect the price of the PRODUCTS as from the date on which the new rate comes into force.
The applicable VAT rate is expressed as a percentage of the value of the PRODUCT sold.
The prices of YUUMAE’s suppliers are subject to change. Consequently, the prices indicated on the SITE may change. They may also be modified in the event of special offers or sales.
The prices indicated are valid, except in the case of a manifest error. The applicable price is the one indicated on the SITE on the date on which the order is placed by the CLIENT.
5.5. Availability of PRODUCTS
The unavailability of a PRODUCT is, in principle, indicated on the page of the PRODUCT concerned. CLIENTS may also be informed of the restocking of a PRODUCT by YUUMAE.
In any event, if unavailability has not been indicated at the time of the order, YUUMAE undertakes to inform the CLIENT without delay if the PRODUCT is unavailable.
At the CLIENT’s request, YUUMAE may:
-
either propose to dispatch all PRODUCTS at the same time as soon as the out-of-stock PRODUCTS become available again;
-
or carry out a partial shipment of the PRODUCTS available initially, then ship the rest of the order when the other PRODUCTS become available, subject to clear information regarding any additional transport costs that may be incurred;
-
or propose an alternative PRODUCT of equivalent quality and price, accepted by the CLIENT.
If the CLIENT decides to cancel his/her order for unavailable PRODUCTS, he/she will obtain a refund of all sums paid for the unavailable PRODUCTS no later than fourteen (14) days following the date on which the CLIENT decided to cancel his/her order.
6. Right of withdrawal
In accordance with Article L. 221-18 of the French Consumer Code, the CLIENT has a period of fourteen (14) days from the day of receipt of the parcel containing the PRODUCTS ordered to exercise his/her statutory right of withdrawal without having to give any reason.
The right of withdrawal may not be exercised for orders relating to:
-
the supply of goods which have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection;
-
the supply of goods made to the consumer’s specifications or clearly personalised.
The CLIENT is hereby informed that PRODUCTS which have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection cannot benefit from the right of withdrawal (in particular, and without this list being exhaustive, cosmetic products whose seal has been removed).
Clients have 24 hours after receipt of the parcel to report any damage. After this period, we will not be able to consider the request.
If the parcel arrives damaged or with traces of liquid, it must be refused or a reservation must be made; otherwise, claims cannot be taken into account.
Consequently, the returned PRODUCT must not have been opened and must be in perfect resalable condition.
These provisions apply without prejudice to the statutory guarantees provided for in the GTCs, which remain fully applicable.
The procedures for exercising the right of withdrawal are set out in the section “Procedures for exercising the right of withdrawal”, available in Annex 1 hereto and accessible at the bottom of each page of the SITE via a hyperlink.
7. Payment
7.1. Means of payment
The CLIENT may pay for the PRODUCTS online on the SITE using the means proposed by YUUMAE.
The CLIENT warrants to YUUMAE that he/she holds all the necessary authorisations to use the chosen means of payment.
YUUMAE will take all necessary measures to ensure the security and confidentiality of data transmitted online as part of online payment on the SITE.
It is specified that all payment information provided on the SITE is transmitted to the SITE’s bank and is not processed on the SITE.
7.2. Date of payment
In the case of a single payment by credit card, the CLIENT’s account will be debited as soon as the order for PRODUCTS is placed on the SITE.
In the event of partial DELIVERY, the total amount will be debited from the CLIENT’s account at the earliest when the first parcel is dispatched. If the CLIENT decides to cancel his/her order for unavailable PRODUCTS, the refund will be made in accordance with the last paragraph of Article 5.5 of these General Terms and Conditions.
7.3. Late payment or refusal of payment
If the bank refuses to debit a card or other means of payment, the CLIENT must contact YUUMAE’s Customer Service department in order to pay for the order by any other valid means of payment.
In the event that, for any reason whatsoever, opposition, refusal or otherwise, the transmission of the payment flow owed by the CLIENT proves impossible, the order will be cancelled and the sale automatically terminated.
8. Evidence and archiving
Any contract concluded with the CLIENT corresponding to an order for an amount exceeding €120 including all taxes will be archived by YUUMAE for a period of ten (10) years in accordance with Article L. 213-1 of the French Consumer Code.
YUUMAE agrees to archive this information in order to ensure a record of transactions and to produce a copy of the contract at the CLIENT’s request. Documents will be stored in electronic format. YUUMAE guarantees access to stored documents upon the CLIENT’s request by email sent to contact@yuumae.com. The invoice for each order is also available in the Client’s personal account area.
In the event of a dispute, YUUMAE will be able to prove that its electronic tracking system is reliable and guarantees the integrity of the transaction.
9. Transfer of ownership
YUUMAE retains ownership of the PRODUCTS delivered until full payment of the price by the CLIENT.
The above provisions do not prevent the transfer to the CLIENT, at the time of receipt by him/her or by a third party designated by him/her other than the carrier, of the risks of loss or damage to the PRODUCTS subject to retention of title, as well as the risks of any damage they may cause.
10. Delivery
The terms and conditions of DELIVERY of the PRODUCTS are set out in the “Delivery Policy” referred to in Annex 2 hereto and accessible at the bottom of each page of the SITE via a hyperlink.
11. Packaging
The PRODUCTS will be packaged in accordance with the transport standards in force, in order to ensure maximum protection for the PRODUCTS during DELIVERY. CLIENTS undertake to comply with the same standards when returning PRODUCTS under the conditions set out in Annex 1 – procedures for exercising the right of withdrawal.
12. Mediation

Furthermore, in accordance with Article L. 612-1 of the French Consumer Code, the CLIENT may refer the matter free of charge to the MEDICYS mediation service to which we are subject:

In the event of a written complaint not resolved by our Customer Service, the CLIENT may refer the matter free of charge to the Mediator.
At European level, the European Commission has also set up an online dispute resolution platform.
13. Guarantees
All PRODUCTS benefit from the statutory guarantee of conformity (as defined in Articles L.217-4 et seq. of the French Consumer Code) and from the guarantee against hidden defects (as defined in Articles 1641 et seq. of the French Civil Code), enabling the CLIENT to return defective or non-conforming products free of charge.
13.1. Statutory guarantee of conformity
Article L.217-4 of the French Consumer Code: “The seller shall deliver goods that conform to the contract and shall be liable for any lack of conformity existing at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter has been made his responsibility by the contract or has been carried out under his responsibility.”
Article L.217-5 of the French Consumer Code: To be in conformity with the contract, the goods must:
1° Be fit for the purpose usually expected of similar goods and, where applicable:
-
correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
-
present the qualities that a buyer may legitimately expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2° Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, made known to the seller and accepted by the latter.
YUUMAE is required to deliver a PRODUCT that complies with the contract, i.e. that is fit for the use usually expected of similar goods and corresponds to the description given on the SITE. This conformity also implies that the PRODUCT has the qualities that a buyer may legitimately expect in light of the public statements made by YUUMAE, including in advertising and labelling.
In this context, YUUMAE may be held liable for any lack of conformity existing at the time of delivery and for any lack of conformity resulting from the packaging, the assembly instructions or the installation where this has been made its responsibility or carried out under its responsibility.
The action resulting from a lack of conformity is time-barred after two (2) years from delivery of the PRODUCT (Article L.217-7 of the French Consumer Code).
In the event of a lack of conformity, the CLIENT may request that the PRODUCT be replaced or repaired, at his/her option. However, if the CLIENT’s choice obviously entails a cost that is manifestly disproportionate compared with the other option available, having regard to the value of the PRODUCT or the importance of the defect, YUUMAE may proceed with a refund without following the option chosen by the CLIENT.
In the event that replacement or repair is impossible, YUUMAE undertakes to refund the price of the PRODUCT within 14 days of receipt of the returned PRODUCT and against return of the PRODUCT by the CLIENT to the following address: 104 Rue Denis Papin, 77550 Moissy-Cramayel.
13.2. Guarantee against hidden defects
The French Civil Code provides the following with regard to the guarantee against hidden defects:
Article 1641 of the French Civil Code: The seller is bound by a warranty on account of hidden defects in the item sold which render it unfit for the use for which it was intended, or which so diminish such use that the buyer would not have acquired it, or would have paid a lower price for it, had he or she known of them.
Article 1648 of the French Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, on pain of foreclosure, within one year of the date on which the seller may be discharged from visible defects or lack of conformity.
YUUMAE is bound by the warranty on account of hidden defects in the PRODUCT sold which render it unfit for the use for which it was intended, or which so diminish such use that the CLIENT would not have acquired it, or would have paid a lower price for it, had he or she known of them.
This guarantee enables the CLIENT who can prove the existence of a hidden defect to choose between a refund of the price of the PRODUCT if it is returned and a partial refund of the price if the PRODUCT is not returned.
13.3. Exclusions from guarantees
PRODUCTS that have been modified, repaired, incorporated or added by the CLIENT are excluded from the guarantee.
The guarantee does not cover apparent defects. The guarantee does not cover products damaged during transport or as a result of misuse.
13.4. Implementation of guarantees
When acting under the statutory guarantee of conformity, the CLIENT:
-
benefits from a period of two years from delivery of the goods to take action;
-
may choose between repair or replacement of the goods, subject to the cost conditions set out in Article L.217-9 of the French Consumer Code;
-
is exempted from proving the existence of the lack of conformity of the goods during the entire period of the statutory guarantee, i.e. two years from delivery of the goods.
The CLIENT may decide to implement the guarantee against hidden defects in the item sold, as defined in Article 1641 of the French Civil Code. In this case, he/she may choose between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the French Civil Code.
For any request relating to statutory guarantees, the buyer must contact Customer Service via the “Contact” section of the SITE or by telephone on +33 (0)1 88 32 92 20 (free service + cost of the call).
These provisions do not exclude the right of withdrawal defined above.
14. Liability
In the online sales process, YUUMAE is only bound by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, service interruption or other involuntary problems.
YUUMAE’s liability may not be incurred in the event of non-performance or improper performance of contractual obligations attributable to the CLIENT, in particular when entering his/her order.
YUUMAE cannot be held liable, or considered to have failed under these GTCs, for any delay or non-performance where the cause of the delay or non-performance is related to a case of force majeure as defined by the case law of the French courts and tribunals.
It is further specified that YUUMAE does not control the websites which are directly or indirectly linked to the SITE. Consequently, it excludes any liability for information published thereon. Hyperlinks to third-party websites are provided for information purposes only and no guarantee is given as to their content.
The CLIENT is responsible for determining that the PRODUCTS are suitable for the use he/she intends to make of them.
Within the limits defined by law, YUUMAE’s liability in the event of breach of its obligations under the GTCs or other legal provisions (including inherent PRODUCT defects) is limited to the refund or replacement of the PRODUCTS concerned.
Prior to placing an order, the CLIENT declares that he/she has full legal capacity to be bound by the GTCs. YUUMAE cannot under any circumstances be required to verify the legal capacity of its visitors and CLIENTS. Consequently, if a person lacking legal capacity orders items on the SITE, his or her legal representatives (parents, guardians, etc.) shall assume full responsibility for this order and shall in particular honour the price thereof.
YUUMAE’s liability under the obligations of the GTCs shall not be incurred where the non-performance of its obligations is attributable to the act of a third party, even if foreseeable, to the fault of the CLIENT, or to the occurrence of a force majeure event as defined by the French courts, or to any other event that was not reasonably under the exclusive control of YUUMAE.
The information accessible on the SITE is provided “as is” without any warranty of any kind, express or implied, including, without limitation, with respect to integrity, accuracy, timeliness, non-infringement, availability, reliability or completeness of the information, products, accessories or services appearing on the SITE or their suitability for the use the CLIENT intends to make of them.
YUUMAE DISCLAIMS ALL LIABILITY FOR DIRECT OR INDIRECT DAMAGE, WHETHER FORESEEABLE OR NOT, CAUSED IN CONNECTION WITH THE USE OF THE SITE. IN THE EVENT THAT YUUMAE’S LIABILITY SHOULD BE ESTABLISHED AND RETAINED IN RESPECT OF DAMAGE SUFFERED BY THE CLIENT AND ATTRIBUTABLE EXCLUSIVELY TO THE PLACING OF AN ORDER, THIS LIABILITY SHALL BE LIMITED TO THE AMOUNT OF THE ORDER PAID BY THE CLIENT.
Any claim lodged by a user, including any CLIENT, against YUUMAE must be made within six months of the occurrence of the event giving rise to the claim.
15. Personal data
YUUMAE collects personal data relating to its CLIENTS on the SITE, including by means of cookies. CLIENTS may deactivate cookies by following the instructions supplied by their browser.
The data collected by YUUMAE are used to process orders placed on the SITE, manage the CLIENT account, analyse orders and, if the CLIENT has chosen this option, send him/her commercial prospecting emails, newsletters, promotional offers and/or information on special sales, unless the CLIENT no longer wishes to receive such communications from YUUMAE.
The CLIENT’s data are kept confidential by YUUMAE for the purposes of the contract, its performance and in compliance with the law.
CLIENTS may unsubscribe at any time by accessing their account or by clicking on the hyperlink provided for this purpose at the bottom of each email offer received.
Data may be communicated, in whole or in part, to YUUMAE’s service providers involved in the order process.
YUUMAE may also ask its CLIENTS whether they wish to receive commercial solicitations from its partners.
In accordance with the law, the CLIENT has a right of access, rectification, objection and deletion of his/her personal data.
The CLIENT may exercise this right by sending an email to contact@yuumae.com or by sending a letter to 49 RUE DE PONTHIEU, 75008 PARIS.
The CLIENT must be able to prove his/her identity, either by scanning an identity document or by sending a photocopy of his/her identity document to the SELLER.
16. Complaints
Any written complaint from the CLIENT must be sent to the following address: 49 RUE DE PONTHIEU, 75008 PARIS.
17. Intellectual property
All visual and audio elements of the SITE, including the underlying technology used, are protected by copyright, trademark law and/or patent law.
These elements are the exclusive property of YUUMAE. Any person who publishes a website and wishes to create a direct hyperlink to the SITE must request prior written authorisation from YUUMAE.
This authorisation from YUUMAE shall in no case be granted on a permanent basis. This link must be removed at YUUMAE’s request. Hyperlinks to the SITE that use techniques such as framing or in-line linking are strictly prohibited.
18. Validity of the GTCs
Any conditions not expressly dealt with herein shall be governed in accordance with the practices in force in the distance selling sector for companies whose registered office is located in France.
19. Amendment of the GTCs
These General Terms and Conditions apply to all purchases made online on the SITE, for as long as the SITE is available online.
The General Terms and Conditions are precisely dated and may be amended and updated by YUUMAE at any time. The applicable General Terms and Conditions are those in force at the time the order is placed.
Amendments to the General Terms and Conditions shall not apply to PRODUCTS already purchased.
20. Jurisdiction and applicable law
The GTCs are governed by French law and any dispute relating to their performance or interpretation shall fall within the jurisdiction of the Paris courts, subject to mandatory legal provisions.
In this respect, it is recalled that Article R 631-3 of the French Consumer Code provides that “the consumer may bring the case either before one of the courts having territorial jurisdiction under the Code of Civil Procedure or before the court of the place where he or she resided at the time the contract was concluded or the harmful event occurred.”
Prior to any legal action, the parties shall seek an amicable solution in a spirit of loyalty and good faith with a view to reaching an amicable agreement in the event of any dispute relating to this contract, including its validity.
The party wishing to initiate the negotiation process shall inform the other party by registered letter with acknowledgement of receipt, stating the elements of the dispute. If, after a period of fifteen (15) days, the parties have not reached an agreement, the dispute shall be referred to the competent court designated above.
Throughout the negotiation process and until its conclusion, the parties shall refrain from bringing any legal action against each other in relation to the dispute subject to negotiation. By way of exception, the parties are authorised to apply to the summary proceedings judge or to seek the issue of an order on request. Any action brought before the summary proceedings judge or the implementation of a procedure on request shall not entail a waiver by the parties of this amicable settlement clause, unless expressly stated otherwise.
ANNEX 1 – PROCEDURES FOR EXERCISING THE RIGHT OF WITHDRAWAL
Withdrawal period
The withdrawal period expires fourteen (14) calendar days after the day on which the CLIENT, or a third party other than the carrier and designated by the CLIENT, physically takes possession of the PRODUCT.
Where the CLIENT has ordered several PRODUCTS via a single order giving rise to several DELIVERIES (or in the case of an order for a single PRODUCT delivered in several lots), the withdrawal period shall expire fourteen (14) calendar days after the day on which the CLIENT, or a third party other than the carrier and designated by the CLIENT, physically takes possession of the last PRODUCT delivered.
Notification of the right of withdrawal
To exercise his/her right of withdrawal, the CLIENT must notify his/her decision to withdraw from this contract by means of an unambiguous statement sent to: 49 RUE DE PONTHIEU, 75008 PARIS or contact@yuumae.com.
The withdrawal form set out below may be used as a template for exercising the right of withdrawal:

For the withdrawal period to be respected, the CLIENT must send his/her communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.
Effects of withdrawal
In the event of withdrawal by the CLIENT, YUUMAE undertakes to reimburse all sums paid for the PRODUCT ordered and returned by the CLIENT, in any event no later than fourteen (14) days from the day on which YUUMAE is informed of the CLIENT’s decision to withdraw.
YUUMAE will proceed with the refund using the same means of payment as that used by the CLIENT for the initial transaction, unless the CLIENT expressly agrees to a different means; in any event, this refund will not incur any costs for the CLIENT.
YUUMAE may withhold the refund until it has received the goods back or until the CLIENT has supplied evidence of having sent back the goods, whichever is the earliest.
Return arrangements
The CLIENT must return the goods without undue delay and, in any event, no later than fourteen (14) days after having communicated his/her decision to withdraw from this contract, to: 104 Rue Denis Papin, 77550 Moisy-Cramayel.
This period shall be deemed to have been observed if the CLIENT sends back the goods before the expiry of the fourteen-day period.
Clients have 24 hours after receipt of the parcel to report any damage. After this period, we will not be able to consider the request.
If the parcel arrives damaged or with traces of liquid, it must be refused or a reservation must be made; otherwise, claims cannot be taken into account.
Return costs
The CLIENT shall bear the direct cost of returning the goods.
Condition of returned goods
The PRODUCT must be returned in accordance with YUUMAE’s instructions and must include all accessories delivered.
If the CLIENT has benefited on the SITE from a conditional promotional offer granting him/her one or more product(s) free of charge in consideration of his/her order and, as a result of the exercise of his/her right of withdrawal, is no longer eligible for the said offer, the CLIENT must return the product(s) he/she wishes to return together with the product(s) received free of charge in consideration of the order for the product(s) returned, so that YUUMAE may take into account his/her request for withdrawal.
The CLIENT may be held liable in the event of depreciation of the PRODUCT resulting from handling other than that necessary to establish the nature, characteristics and, where applicable, the proper functioning of the PRODUCTS.
The CLIENT is only liable for any depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the PRODUCT.
PRODUCTS must imperatively be returned to YUUMAE in a condition suitable for resale (products in perfect condition accompanied by their original packaging, accessories, instructions, etc.) within fourteen (14) days from the date on which the CLIENT informed YUUMAE of his/her decision to withdraw from the distance selling contract and no later than fourteen (14) days from the date of receipt of the order by the CLIENT.
Returns of products sent beyond this period will not be accepted.
Exclusions from the right of withdrawal
The right of withdrawal is excluded in the following cases:

Supply of goods or services whose price depends on fluctuations in the financial market;

Supply of goods made to the CLIENT’s specifications or clearly personalised;

Supply of goods likely to deteriorate or expire rapidly;

Supply of sealed audio or video recordings or sealed software that have been unsealed after delivery;
-
Newspapers, periodicals or magazines (except subscription contracts);
-
Provision of accommodation services other than for residential purposes, transport of goods, car rental, catering or services relating to leisure activities if the offer provides for a specific date or period of performance;
-
Supply of goods which, by their nature, are inseparably mixed with other items;
-
Supply of sealed goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the CLIENT after DELIVERY;
-
Supply of alcoholic beverages, the price of which was agreed at the time of conclusion of the sales contract, the delivery of which can only take place after 30 days and the actual value of which depends on market fluctuations beyond YUUMAE’s control;
-
Supply of digital content not supplied on a tangible medium, where performance has begun with the consumer’s prior express consent and acknowledgement that he/she thereby loses his/her right of withdrawal;

Contracts concluded at a public auction.
ANNEX 2 – DELIVERY POLICY
Delivery area
The PRODUCTS offered can only be delivered within the TERRITORIES listed below: mainland France, the French overseas departments and territories (DOM-TOM) and Belgium.
It is not possible to place an order for any delivery address located outside these TERRITORIES.
The PRODUCTS are shipped to the delivery address(es) indicated by the CLIENT during the ordering process.
Dispatch time
The time required to prepare an order and then issue the invoice, before dispatch of the PRODUCTS in stock, is indicated on the SITE. These times do not include weekends or public holidays.
An email will automatically be sent to the CLIENT when the PRODUCTS are dispatched, provided that the email address given on the registration form is correct.
Delivery time & charges
During the ordering process, YUUMAE will inform the CLIENT of the different delivery methods and times available for the PRODUCTS purchased.
Shipping costs are calculated according to the delivery method. The amount of these costs will be payable by the CLIENT in addition to the price of the PRODUCTS purchased.

Delivery problems
The CLIENT is informed of the delivery date when choosing the carrier at the end of the online ordering procedure, before confirming the order.
It is specified that deliveries will be made within a maximum period of thirty (30) days. Failing this, the CLIENT must place YUUMAE in default to deliver within a reasonable period, or may terminate the contract and request a refund of his/her order.
YUUMAE will reimburse the CLIENT, without undue delay from receipt of the termination letter, the total amount paid for the PRODUCTS, including taxes and delivery costs, by the same payment method as that used by the CLIENT to purchase the PRODUCTS.
For parcels returned due to the expiry of the time limit for collection at a pickup point or the CLIENT’s absence, we issue a credit note equivalent to the amount of the order, excluding shipping costs.
